摘要
我国矿产资源开发过程中的环境法制建设和执行方面存在着诸如企业和公众法制观念淡薄,矿产资源开发环境保护法规制度建设滞后,环境执法不利,环境司法亟待加强等问题。应认清形势,增强环保意识,提高法制观念,认真落实各项环保法规和矿产资源法,强化执法制度建设,加大执法力度,建立健全相关配套政策、机制,以使矿产资源开发与环境保护协调发展。
The author discuss the legal situation of mining resources exploitation in China,such as legal awareness of enterprise and the public is becoming indifferent;no perfect environmental protection laws and regulations can match the development of mineral resources;working with no or little efficiency in environmental law enforcement;environmental justice should be strengthened.In response to this situation,the paper puts forward some countermeasures for realizing the coordinated development of mineral resources exploitation with environmental protection,the specific methods include: becoming more aware of environmental protection as well as legal awareness;conscientiously implementing the various environmental regulations,and the law on mineral resources,strengthening the law enforcement system;establishing and improving related policies and mechanisms.
