摘要
中国所面临的特定的社会转型背景条件以及特定的社会导向,使得中国现阶段的劳动政策呈现出一些明显的特征:在许多重要的方面出现同国际接轨亦即某种国际化的情形;在劳动保护政策落实和实施方面,尽管目前各类企业的情况均不容乐观,但其间有明显差别,大致来说,外资企业最好,国有企业其次,私营企业再次;劳资纠纷正处在一个迅速上升的通道,过了这个时期,中国的劳资纠纷才有可能处在一个相对稳定的状态;劳动保护政策的实施呈现出复杂的情势,往往会陷入两难的境地,并且会给中国社会经济的总体发展带来一定的影响。
The labor policy in recent China has some obvious features in the context of social transformation and specific governmental orientation. Firstly, it has some trends to adapt the international criterions in many important dimensions, in terms of internationalization. SecondLy, there is a obvious difference between various types of enterprise on the aspect of putting labor policy into practice, al- though they are totally not very good, which the foreign-capital enterprises are the best, the state- owned enterprises are better than the private-owned enterprises in general. Thirdly, the labor disputes have rapidly raised in recent years. Only China passes this period could the conflict between employer and employees becomes relative stable. Fourthly, the practice of labor policy will be more complex and often fall into a dilemma, which should influence the social and economic development of China.
