摘要
帮助自杀的定性是一个争议已久的问题,一直困扰着理论界和司法界。长期以来,帮助自杀与公民生命权的保障存在着冲突与矛盾,但帮助自杀的合法化是一种价值选择的趋势。我国应该使帮助自杀行为非罪化,并对帮助自杀行为在中国语境下予以重构。
It＇s has been a controversy of the definition of assisted suicide which has been besetting the theoretical and judicial circles. The conflict and contradiction between assisted suicide and the guarantee of citizens＇right has been in existence for a long time. The legalization of assisted suicide is a kind of trend of value choice. Our country should make assisted suicide actions non - criminalization,and help assisted suicide actions to reconstruct under the Chinese context.
