拟议中的全球专利制度的对策——权利架构与制度安排 被引量：1

摘要 当前,同一发明创造寻求多国专利保护面临重重困难。发达国家提议建立可授予在全世界有效的单一专利权的全球专利制度,这项制度对我国而言有利有弊。若我国不得不参与其建设进程,可以推动其建立如下方案:由全球专利局授予全球专利权人一个抽象的实施权,效力及于全体成员国,但具体实施权利内容由各国国内法规定。并且在此基础上,争取使其制度安排有利于新技术的使用,同时加强审查员和专利法官队伍的建设。
