摘要
非物质文化遗产法律保护是行政法和知识产权法面临的新课题之一。我国台湾地区建构了非物质文化遗产的行政保护制度,并对原住民族传统智慧创作创设专用权。我国大陆正在研究制定非物质文化遗产保护法,台湾的相关立法如直接对某些非遗授予知识产权特别权利等可以为我们提供某些启示。
The protection of intangible cultural property is a new issue for administrative law and intellectual property law. The protection of intangible cultural property by administrative law traditional creations has been built in Taiwan. The law of intangible cultural property the People＇s Republic of China. And the former can provide some inspiration to the and the exclusive right of this is on the way of constituting in latter, such as recognizing the sui generis IP on the intangible cultural property.
