摘要
对于传统犯罪构成理论的三阶段发展史,可以从四个维度进行解读:从著述类型来说,犯罪构成的研究呈现出著作少,期刊论文多,总体研究不够系统和深入的局面;从研究过程来说,主要是一个移植、模仿域外犯罪构成理论的历史,随着我国社会政治形势的风云变幻,经历了一个肯定——否定——否定之否定的发展过程;从发展趋势来说,学界呈现出引进德日犯罪论体系进行理论重构的态势;从学术品格来说,犯罪构成日益摆脱、削弱对政治的依赖而获得越来越强的独立品格。
The three stages of the traditional crime constitution theory can be interpreted in four dimensions. In terms of types, there are far more journal articles than works on the study of crime constitution. The researches are generally less systematic and in-depth than they should. In terms of the research procedure, the researches mainly transplant and imitate foreign crime constitution theories. With the rapid changes in our social political situation, the researches have experienced a developing process of affirmation-negation-the negation of negation. From the perspective of the development trend, there is a tendency in the academia to introduce German and Japanese crime theories for theoretical reformulation. In terms of the academic style, the theory on crime constitution, while ridding itself from politics, is becoming more independent.
