摘要
对不动产征收必须出自公共利益的目的,法国与中国的规定并不具有原则性差别,但法国的不动产征收中公共利益的调查等一系列程序,公共利益界定标准的确立以及司法权的有效介入等措施有效保障了不动产征收符合公共利益的目的。而我国不动产征收相关规定的欠缺,程序设置不科学与操作的不规范等难以有效保障公益征收的正当性,这些需要我国对此加以改变。
The expropriation of real property in France must accord with public interest is just as the same as China. In France, there are series of procedures for the establishment of standards to define public interest, as well as the effective intervention of the judicial power which effectively protect the expropriation of real property for the purposes of public interest. In China, the lack of the relevant provisions and unscientific procedures and the non--standard operations are difficult to protect the expropriation of real property for the public interest which should change.
