摘要
城市房屋拆迁一直是社会关注的焦点。在我国城市房屋拆迁制度的探讨中,更多关注拆迁过程中的土地征收和征用、补偿安置、被拆迁人合法权益的维护、公共利益的界定等内容,而对拆迁过程中政府的行为讨论较少。事实上,我国目前的城市房屋拆迁工作,政府扮演着非常重要的角色。城市房屋拆迁中的政府行为,包括行政行为和行政相关行为,存在诸多问题,需要在法律层面认真研究并加以完善。
Urban house demolition has been the focal point which the society pays attention to. In the discussion about demolition system of urban housing. In the course of discussion , the theme were laid on land levy and requisition,compensation placement and resettlement,legitimate rights and interests maintenance , but the conduct of the government less. In fact, China＇s current system of urban house demolition,from beginning to end all government involvement,in which the government plays a very important role. This paper studies the urban house demolition in the conduct of the government, including the relevant administrative acts and administrative acts, the issues, and all these should be perfected and researched based on law.
