摘要
从1988年全国人大起草《国家行政工作人员报告财产和收入的规定草案》,至今已经21年,我国财产公示制度由于种种原因一直未能出台,这不仅有体制性因素还有伦理性因素。而伦理性因素的研究和分析在某种程度上却被忽视。本文以公务员财产公示与行政伦理的逻辑关联为切入点,着眼于行政伦理的外部责任与内部责任的关系,从行政伦理角度对公务员财产公示的伦理困境进行剖析,试图寻找合理的解决对策,以使公务员能够直面财产公示,营造依法申报财产公示的氛围,建立切实可行的财产公示制度。
It has been 21 years since the ＇ Draft of the Provisions of State Administrative Staff Report on Property and Income＇ was drafted by National People＇s Congress. However, property declaration system has never been made into a law due to ethical factors as well as system ones, which have always been neglected to some extend in the research done in this field. Taking the relationship between civil servants＇ property declaration and administrative ethics as a starting point, this paper focused on the relationship of external and internal administrative ethics, and conducted an analysis on the ethics dilemma in civil servants＇ property declaration from an ethical point. The paper also made some effort in trying to find sound and reasonable solutions to nurture an environment where civil servants may face fewer difficulties towards property declaration, thus ensuring the establishment of a practical system for them to make declarations.
