摘要
以保护患者知情权为视角,结合现行法律规定和医疗实践,从理论上探讨纸质病历的所有权、著作权、信息知情权、档案性质等法律属性。认为病历原件归患者所有是可取的制度安排,病历著作权应当归医疗机构享有,病案所有权具有不同层次,同时各项权利之间存在着密切的关系。
Combined with the existing legal provisions and medical practice, theoretically exploring the ownership, copyright, right of information, the nature of archives of medical record is highly necessary. The patient＇s right of information is decisive and basic, that the patient has the ownership of the original medical record is desirable system arrangement, the copyright of medical record shall be enjoyed by the medical institutions, the ownership of medical archives shall be owned by different subjects.
