摘要
监督是地方人大的一项重要职能,也是地方人大推进依法治国的重要保障。在现实生活中,地方人大监督缺位、形式主义、漏监、弱监等现象与其至上的地位形成强烈反差,因而备受诟病。虽然在一定程度上可归咎于现实的困境,但地方人大自身缺乏内在动力,主动监督意识不足,即地方人大监督不作为之表现乃是其至上地位和职能难以彰显的重要原因。认识和规制地方人大监督不作为,有助于在现实制度框架下,最大程度地改变地方人大的面貌。
Oversight of the executive is the key functions of the local people s congress and an important means of promoting the rule of law by the local people s congress.In reality however the absence of oversight,formalism,omission of oversight and weak oversight by the local people s congress constitute a stark contrast to the presumed high status of oversight,which have been much criticized quite commonly.Though it is in part due to difficulties in reality of the omission in oversight,i.e.,the lack of internal internal impetus and initiative to exercise oversight by the local people＇s congress is the major cause of the diminishing of their high status and function. It will change the situation of the local people＇s congresses and give play to their core status and function to the greatest extent available in the current institutional framework by analyzing the constitution and phenomenon of omission in oversight by the local people＇s congress and the causes,as well as overhauling and regulating the omission in oversight by the local people congress.
