摘要
我国现行宅基地的使用权制度是在集中资源优先发展重工业的背景下发展起来的,与计划经济、城乡分割体制相适应,采取了均分、无偿、行政审批的取得方式,宅基地使用权取得制度被异化,限制了集体和农民的土地权利,造成了土地资源的浪费。在城市化、市场化背景下,宅基地利用必须符合效率原则和城乡平等原则,应从恢复宅基地使用权取得的私法性质、完善宅基地使用权取得程序、逐步推行宅基地使用权的市场化配置、完善救济制度等方面对现行宅基地使用权取得制度加以完善。
Chinese current system of housing land use right was established and developed in the context of pooling resources to give priority to heavy industry development. To fit with planned economy and different policies in rural and urban areas, it adopted such acquisition means as equipartitiou, free of charge, administrative examination and approval. Thus the acquisition system of housing land use right has been alienated and as the result of which, it limited land rights of collectivity and peasants and caused the waste of land resources. In the background of urbanization and marketization, housing land use must be in accordance with efficiency principle and urban-rural equality principle. We should improve current acquisition system of housing land use right in terms of resuming the private law nature of housing land use right, perfecting acquisition procedure of housing land use right, gradually pushing ahead with market allocation of housing land use right, improving relief system and so on.
