摘要
中国集体林权制度改革的价值目标包含了发展经济、有利民生和保护生态三方面的内容,如果改革能使这三方面的价值目标同步实现,必将给国家、集体、个人和环境带来福音。但在实践中,这三个目标之间可能出现的冲突会给改革带来阻力。了解冲突的原因和寻求冲突的化解方式是实现林权制度改革目标的基础。文章结合传统与现实、习俗与法律、个人与社会、发展权与环境权、集体权利与公共利益等方面论述了林权制度改革中价值冲突的原因、表现和解决途径。
The value of collective forest tenure reform embodies economy development, benefits to people' s livelihood and protection to ecological environment. If the reform could go well simultaneously with the three values, it would bring the bliss to the nation, the collective, the individual and the environment. However, in practice, the conflicts are latent within those values. The implementation of this reform is based on knowing the reason of conflicts and seeking means to deal with the conflicts. This article mainly analyses the phenomenon and the reason of conflicts, the approach to deal with conflicts by viewing tradition and reality, custom and law, individual and society, right to development and right to environment, collective rights and public interest.
