摘要
本文对提单的运输合同属性和物权凭证属性、货运代理提单的物权凭证属性、交换提单、过期提单的概念及其法律问题进行了研究,对学术界关于上述问题的一些误解提出了修正建议,以期在学术界和实践中统一对上述问题的认识,正确处理与提单有关的实践问题。
This paper focuses on the contractual and property-evidence nature of both bill of lading on general and the forwarder＇ s bill of lading. The implications of switched bill of lading and stale bill of lading are also discussed. The probably new ideas of this paper are that some improper understandings on the above-mentioned concepts are pointed out and corrected.
