摘要
《劳动争议调解仲裁法》的出台对我国现行的劳动争议处理程序进行了较大幅度的改革,解决了长期困扰我国劳动争议处理的周期过长、申请仲裁时效过短和争议处理成本过高等问题。但是,我国"一裁两审"的劳动争议处理模式没有根本改变,其带来的问题仍然制约着我国劳动争议及时、有效的处理。因此,应当结合我国的国情,改革我国的劳动争议处理体制,充分利用当前的资源,处理好眼前利益和长远目标,明确各阶段的改革目标,完善劳动争议处理程序。
The adoption of 'Labor Dispute Conciliation and Arbitration Law of PRC' gives many revisions for China's current labor dispute disposal procedures which solves long-standing problems such as long labor dispute cycle,too short limitation of arbitration and high dispute disposal costs.However,China's 'one arbitration and two trial' mode of the labor dispute processing has not been fundamentally changed,and the problems arising from labor disputes in China continue to restrict the timely and effective resolution.Therefore,the reform of China's labor dispute disposal system,should be combined with China's national conditions and makes full use of current resources to handle the short-and long-term goals and clarify specific objectives of each phase of reform so as to improve the labor dispute processing mode in China.
