摘要
行政自由裁量权有其存在的必然性和必要性,但目前规划许可中行使自由裁量权存在缺少明确的操作规则与程序设定、缺乏有效的监督与纠错机制等问题。从行政法学的角度,研究认为要规避这些负面问题,优化行政效能不应该简单的对规划行政自由裁量权"限权",而是应该选择合适的方式"控权",实现程序控权与实体控权的协调统一。首先,充实自由裁量控权依据,兼顾制约性规则与激励性规则、合法性标准与合理性标准;其次,完善"行政流程"的要素与程序设计,注重行政双方"交涉性"与"反思性",程序上赋予行政相对人和公众更多参与的权利,并设定行政主体在程序上相应的义务;第三,从增加违约成本、降低维权成本两方面双管齐下,形成对自由裁量的监督和纠错机制。
The administrative discretion is indispensable and necessary.But there are problems of discretion in planning permission including the absence of a clear set of rules and procedures to operate;the tendency of unlimited discretion based on private interests;lacking of effective mechanism for monitoring and controlling.From the perspective of Administrative Law,it is suggested that the discretion should be controlled based on the harmony of procedural and substantial power by proper means rather than simple restriction.This paper focuses on three issues to promote administrative performance:enriching law and regulations on discretion;improving the elements and procedure design of positive administration and increasing the cost of discretion default and reducing the cost of right-safeguarding.
