摘要
法律所具有的知识理性与实践理性双重身份决定了法学教育的双重任务,但由于种种原因,法律实践理性培养在法学教育中缺位,使得中国法官职业化遭遇困难。法律实践理性包括思维理性与行为理性两个方面,是法官职业化的核心和基础,必须受到高度重视。应将法律实践理性养成确定为法官职业培训目标,同时对法学院教学进行相应的改革,实现法学院教育与法官培训、法学家与法律家培养的有机衔接。
Knowledge reason and practical reason which are the dual status possessed by law determine the double tasks of law education, however, under kinds of reasons, the foster of practical reason of law is lost in law education that obstacles the professional to Chinese judge. The practical reason of law contains thought reason and behavior reason is the kernel and fundamental of judge professional that should be accepted highly attention. The foster of practical reason of law should be the target of training of judge, meanwhile, the teaching of law institute should be reformed accordingly, realizing the smooth joint between education of law institute and judge training, and between jurist and the foster of jurist.
