摘要
《劳动合同法》实施后引发了学界较大的利弊争论。通过对《劳动合同法》执行力的基本理论分析,结合该法实施后农民工的就业现状调查结果,指出当前《劳动合同法》在农民工就业环境塑造问题上缺乏执行力的主要表现并进行法律原因分析,最终提出加强《劳动合同法》执行力的几点举措。从客观上讲,《劳动合同法》加大了对劳动者的保护力度,更加细化了劳动者权益保护标准,尽管自身仍存在诸多不足,但也弥补了旧有法律的不足,在实践中加强法的执行力是能够有效改善农民工的就业环境的。
Labor contract law implementation causing ardent debate on it's advantages and disadvantages.Through basic theoretical analysis in the labor contract law's executive ability,combining with investigation result in the current status of peasant labors ' employment,to point out manifestations of the lack of labor contract law's executive ability and analysis law reasons,to put forward suggestions to solve the problems finally.Objectively speaking,labor contract law strengthened the power of worker protecting and refined standard of protection of laborers ' rights and interests.Although it still exists many disadvantages,labor contract law remedys to defects of original law.In practice,strengthening labor contract law's executive ability can improve peasant workers' employment environment effectively.
