宅基地换房经营主体制度创新探讨

摘要 政府投资公司作为宅基地换房的经营主体存在政企不分、置换对价不合理、住房安置标准不公平、置换后的利益分成失衡等弊端。合作社成为宅基地换房经营主体有利于维护村集体利益,为壮大集体经济打下基础;有利于维护农民利益,树立农民主体性地位;有利于降低政府置换成本,又可实现节余建设用地指标的目标;有利于降低开发商的投资门槛,落实节余宅基地去向;有利于降低土地经营利用风险。在此基础上,设计了合作社经营主体制度。 There are some disadvantages for government investment company as the operatng body of exchanging housing with rural house sites.They are(1)no distinction between government and enterprise,(2) unreasonable exchange price,(3) unfair standard for housing settlement,and(4) imbalance of benifit sharing after the exchange.On the contrary,there are more advantages for the cooperatives as the operating body.It is beneficial to protect the interests of the village and villagers,to lower the cost of exchange and achieve the target of saving construction land quota,to lower access to real estate investors,and to reduce the risk of land operation.On this basis,the paper designs the system of cooperatives as the operating body.
