摘要
在宪法解释学勃兴的背景下,论证宪法解释的正当性具有重要意义。在理论上,正当性研究将促使整个宪法解释学体系更加完善。在实践上,宪法解释的正当性为释宪制度和释宪行为提供理论支持,它是确定释宪主体,选择释宪方法,架构释宪体制的依据。在内涵解读、目的分析和比较研究的基础上,可以发现宪法解释之正当性在于合乎主权者认诺,且宪法解释应当在这一原则的统摄下发展完善。
In the background of constitutional interpretation develops continuously, it is of great significance to analyze the legitimacy of the interpretation of Constitution. In theory, it can make the entire interpretation system more perfect. In practice, legitimacy is the foundation of the constitutional interpretation system, and it provides theoretical support for the acts of constitutional interpretation. It is the basis of the structure for constitutional interpretation and also determines who can interpret, and how to interpret. Based on concept research, purpose analysis and comparative study, it is obvious that the legitimacy of constitutional interpretation is the agreement of sovereign, the improvement of constitutional interpretation should comply with this principle.
