摘要
适龄青少年在职业学校学习及在企业参与顶岗实习,是一种使他们能够顺利融入社会及职业,从学校过渡至劳动力市场的职业培训活动,也是一种国家对后备劳动力的重要人力资源开发与规划。实习学生的身份应认定为属特殊劳动者,其实习过程中的劳动权益应受到我国劳动法有区别和针对性的保护。借鉴国内外各地的经验和做法,我国劳动行政主管部门应加强对企业使用实习学生行为的监督检查,保护实习学生权益,并防止对在职劳动者工作岗位的不当替代。
The post practice of youngsters in vocational schools and enterprises is a kind of professional training activity that can help them make transition from school to society and work as well as an important human resource development and planning activity for cultivating preparatory workforce. The identity of these students can be recognized as a particular labourer, and the labour rights and interests during their practice process should be protected by the Labour Law pertinently. Referring experiences and methods in foreign countries, the labour departments in China should strengthen monitoring and examination on the behavior of students’ training in enterprise, protect the rights and interests of students and prevent the improper substitute of working posts of real workers.
