摘要
为了考察影响中东国家法律现代化的因素,采用实证及比较分析的方法,研究欧陆法对土耳其和埃及法律现代化的影响,认为土耳其和埃及民法典均大量借鉴和移植了欧陆民法的制度和规定,采取本国法与外来法相结合的法律改革模式,开辟了中东国家法律现代化的独特路径。
In order to investigate the effect factors on the modernization of Islamic civil law in coutries of Middle East through comparative analysis of the representative researches,it is concluded that Civil Code of Turkey and Egypt transplanted the European civil law systems and regulations and adopted the legal reform mode of combination of Middle East native law and Continental law, which are unique approaches on the modernization of civil law in coutries of Middle East.
