摘要
BT下载在为人们带来便利的同时,社会危害性也日益凸显,需要刑法加以调整。基于BT下载的特点,各方主体的行为和作用不同,需要承担的刑事责任也各不相同。在现行刑法体系下,BT下载可能涉及侵犯著作权罪,制作、复制、传播淫秽物品牟利罪等罪名;从立法完善的角度看,对于一些具有严重危害性的BT下载帮助行为,应加以入罪化。
While the BT downloading brings people the convenience,its social hazardous nature also come to the highlights day by day,which needs the criminal law to adjust.Based on the characteristics of BT downloading,the behavior and function of the main body of all quarters are different,the legal responsibility is also various.Under the present criminal law system,the BT downloading possibly involves encroaches upon the copyright crime,crime of manufacture,duplication,charges dissemination obscene goods to seek money;Looking from the legislative perfection angle,for some serious hazardous of BT downloading behavior,they should get penalty.
