摘要
公民参与不仅是一种政治活动,还是公民的基本权利,即参政权。阐述了公民参与的理论,并从宪政角度分析了公民参与的意义,即公民参与政治是民主化的动力,公民参与法律是法律秩序建构的活力;分析了公民参与的困境"公民冷漠"和由"多数暴政"引起的工具化倾向,评述了我国公民参与的现状和不足,并提出完善途径:信任大众,完善参与的法律机制;克服"多数暴政",建立协商民主。
Besides the political activities,citizen participation is also the fundamental rights of citizens,namaly,the right to political participation.This paper interprets the theory of citizen participation,analyzes the the signifi-cance of citizen participation,namely,the citizen participation in politics is the driving force of democratization,the citizen participation in Law is liftblood of the construction of the order;the paper analyzed the dilemma of citi-zen participation in ‘political indifference’and the‘tyranny of the majority’,it reviewed the status and the de-fectds of citizen participation in our country.In the end,the paper made conclusion as follows： confidence in the public,improve the participation of legal mechanisms;the social transformation of our democracy should highlight deliberative democracy.
