摘要
国际规范是国际社会中具有明确约束力的规则体系,其权威性主要由两个指标来衡量:社会确认与制度化水平。社会确认是指国际规范遵守者的数量,拥有越多支持者的国际规范,越会对外部国家产生从众效应。制度化水平是指规范拥有严密的规则内容和制度化形式的程度,包括规则的可操作性、正式的组织机构和固定的人员,以及决策程序等等。同时,制度化水平还突出体现在惩罚机制上。具有高度制度化水平的国际规范能够避免和抑制违约行为。
International norms are the rule system in international society,which have clear-cut binding force.Their authoritativeness is measured by two indexes: social recognition and institutionalization level.Social recognition refers to the number of actors complying with specific international norms.More supporters of international norms will lead to the conformity effects upon outside states.Institutionalization level means to what extent the norms have rigorous rule content and institutionalized form,including the functionality of rules,formal structure,stationary staff and decision making process.Meanwhile,institutionalization level is prominently reflected in the punishing mechanism.Highly institutionalized international norms may prevent and curb non-compliance.
