摘要
社区矫正作为一种非监禁刑罚执行方法,对预防犯罪、化解社会矛盾、构建和谐社会具有至关重要的意义,如何使这一司法政策达到预期的社会效果,使刑罚的执行不逾越法律的轨道,对社区矫正的执行者、执行内容、执行过程进行检察监督极具紧迫性和必要性。与监禁刑检察监督相比,非监禁刑的检察监督具有特殊性,探讨构建一个行之有效的检察监督机制具有极大的现实意义。
As a non-imprisonment punishment method,community correction is of key importance to prevent crime,eliminate social contradiction and construct harmonious society.How the judicial policy to achieve anticipated social result and guarantee the enforcement of punishment in the frame of law is of great necessity and urgency to the imposing of procuratorate supervision to the subject of enforcement,the contents of enforcement and the process of enforcement of community correction.Compared to procuratorate supervision of imprisonment punishment,the procuratorate supervision of non-imprisonment punishment is special,and the discussion of an effective procuratorate supervision mechanism is of great significance.
