摘要
流动人口服务管理程序主要涉及流动人口服务管理法律适用包括管理、调查取证、行政强制措施等程序规定。在对流动人口的法律保障方面,我国宪法法律和行政法规中仍然存在着立法上的空白和限制;流动人口服务管理的执法理念在于警察调查权与流动人口基本权益的平衡。因此,针对流动人口服务管理领域的立法、司法和行政活动,对其基本理念、范畴和职能定位的系统梳理显得尤为重要。
The procedure of management services of floating population is mostly involved with its application regulations,such as management,investigating and collecting evidences,administrative compulsory measures,and so on.On the aspect of legal guarantee for floating population,there still exist blank space and limitation in the Constitution,laws and administrative regulations.The law enforcement idea in management services of floating population lies in the balance between police investigation power and basic rights and interests of floating population.Therefore,it is important to demonstrate the basic concepts,category and function orientation of legal,jurisdictional and administrative activities in the field of management services of floating population.
