摘要
建设城乡统一的建设用地市场是农村土地流转的改革方向,但地方政府作为现存制度的既得利益方,不会主动放弃征地模式,需要中央政府层面进行一系列的制度设计。本文的研究认为,对地方政府更大的政治压力、更多的保护农民利益的法律判决、农民保护土地产权意识的觉醒等因素都有助于地方政府逐步放弃征地策略。城乡统一的建设用地市场并未解决规划区外集体经济组织的土地产权实现的问题,只有与建设用地的异地流转机制相结合,才能解决新的市场失灵问题。为此,应赋予各集体经济组织平等的土地发展权,通过土地发展权的交易实现规划区内外集体经济组织的土地产权价值。
Building a unified construction land market is the trend of rural land reform,but the local government as the vested interests of the existing system will not give up land acquisition mode.A series of system design should be conducted in the central government level.This research suggests that greater political pressure,more law decision to protect the interests of farmers,the farmers' consciousness to protect the land rights and other factors all help to push local governments to gradually give up land acquisition strategy.A unified construction land market can not realize the issue of land ownership outside the city planning region.To solve the new problems of market failure,remote transfer mechanism is necessary.To this end,the collective economic organizations should be given equal development rights.Through the trade of the land's development right,the property value of the land of the collective economic organizations inside and outside the region can be realized.
