摘要
区域海洋环境保护法律制度是国际环境法中最完善的环境保护法律制度。它具有不同于全球性海洋环境保护法律制度与国内海洋环境保护法律制度的独特性:在法的形成及适用范围上,具有明显的区域性特征;在合作机制上,以区域国家间的合作为基础;在法的效力上,呈现出"硬法"化趋势;在法的实现上,以理性集体行动的方式实现立法目的。对区域海洋环境保护法律制度特点的研究为诸如海洋环境污染等全球性环境问题及其他全球性问题的解决提供了重要的启示。
Legal systems of regional marine environmental protection, which are the perfect ones in international environmental law, are different from global and domestic ones： in formation and scope of application of law, they have regional characteristics; in cooperative mechanism, they are based on cooperation among countries in regions; in validity of law, they present ＂hard law＂ trend; in realization of law, they tend to fufill the aim of the law in the form of rational collective action of regional marine environmental protection. They give lessons for solving global environmental problems, such as marine environmental pollution and so on, and other global problems.
