摘要
农村宅基地的流转开发,是当前农村土地流转开发工作的重要内容,也是社会主义新农村建设深入发展过程中出现的重要课题。本文从农村宅基地流转开发角度,分析了我国现有法律制度关于农村土地管理的相关规定,包括基本土地制度、土地管理,特别是农村宅基地管理的法律规定,探讨了新农村建设中有关土地管理的法律制度建设,分析了现有法律体系的特点、存在的问题、法制建设的缺陷,从提高农民的法律意识、完善农村宅基地管理的法律规范、发挥城镇建设规划的引导作用、完善村民住宅登记制度、建立农民住宅建设激励制度五个方面提出了完善农村土地管理,特别是宅基地管理的法制建议。以此不断完善农村宅基地开发的法制建设,建设好现代化的新农村。
Rural house land transfer is an important aspect of rural land transfer, and also a very important topic during social new rural construction. This paper, based on rural house land transfer, analyzes the relevant provisions of the rural land management, including basic land system, land management, especially in rural residential land management laws and regulations, discusses the legal system construction of land administration in new countryside construction, and studies the characteristics of existing law system, problems, and drawbacks in legal system construction, and presents suggestions improving rural land management, and especially rural house land management from farmers' consciousness in laws, rural house land management, urban construction planning, farmers registration system and farmers house construction incentive system, aiming at improving the laws construction in rural house land development and constructing a new modern countryside.
