摘要
1980年发布的《中华人民共和国学位条例》是新中国成立以来第一次由最高权力机关制定的有关教育行政的法律。这部法律的创制是国家公正观逐步走向成熟的标志。由于社会条件在发生变化,《学位条例》面临立法定位、创制观念与提升可执行性等诸多方面的挑战。明晰《学位条例》作为学位教育行政法的定位,加强其对学位工作行政关系的调节与规范能力,是未来学位教育行政法治工作的重点,是提升社会对学位工作公正度评价水准的关键。
Enacted in 1980, Regulation on Degrees in People's Republic of China is the first law pertinent to educational administration stipulated by the supreme authority since new China was founded. The stipulation of the law is the symbol of national equity being mature. Owing to the changing social conditions, the Regulation on Degree faces challenges of legislation, stipulation and implementation. It is the key to rule of administration and by law positioning the Regulation on Degree as degree education administrative law and enhancing the coordination and conducting of degree tasks. It is the key to improving the public evaluation about fairness of degree tasks.
