摘要
生育保险,一般是指国家通过立法对怀孕、分娩的女职工给予生活保障和物质帮助的社会保险制度。但是并非只有女职工才是享受生育保险待遇的唯一主体,男职工也是生育保险待遇的享受主体之一。结合我国很多地方立法已经赋予男职工享受生育保险待遇的权利的实际,并借鉴国外立法经验,我国应当在国家层面的立法中赋予男职工享受生育保险待遇的权利。
Maternity insurance generally refers to the social insurance system,which the state gives the pregnant,childbirth female workers living and material assistance through legislation.But not only are female workers the only subject receiving maternity insurance benefits,male employees are the subject who should enjoy maternity insurance benefits as well.In practicel,most local legislations in our country have given male workers the right to enjoy maternity insurance benefits,and from the legislative experiences abroad,our legislation at the national level should allow male workers to enjoy of the right of maternity insurance benefits.
