摘要
长江流域的水体污染、生态恶化等问题日益严重,迫切需要制定一部《长江法》实施对长江的严格管理和有效保护。长江立法的核心问题在于流域管理体制与运行机制的改革。我国目前的流域管理体制存在机构设置重叠、多头管理、多龙治水等现状,现有的流域管理机构的性质和权限不足于实现综合统一管理的职能。本文分析了我国现行流域管理体制存在的问题,阐述了改革流域管理体制的客观要求,初步构建其体系,从创设新型的流域管理机构、流域监督机构、流域管理委员会以及明确地方政府职责等方面提出建议,从而为《长江法》的制定奠定理论基础。
As water pollution and ecological degradation in the Yangtze River basin is increasingly serious,it is urgent to develop the Yangtze River Law that can strictly manage and effectively protect the Yangtze River.The core of the legislation of the Yangtze River is the reform of management system and operation mechanism.The overlap institutions and excessive departments of administration fail to achieve an integrated and holistic management of the Yangtze River basin in China's current system of river basin management.The paper argues that it is of great significance to establish a new management system of the Yangtze River basin.Then it proposes some suggestions on new management organizations,supervision organizations,management committee and the responsibility of local government,which lay foundation for the establishment of the Yangtze River Law.
