摘要
侦查权具有特殊性,在推行法治的现代社会,需要对其进行制约和监督。制约和监督侦查权的方式是多样的,其中包括了侦查程序对侦查权的制约、来自侦查机关组织和系统的内部监督与来自检察机关和社会公众的外部监督。"检警一体化"的观念有待商榷,与之相比,检察机关引导侦查的主张更为可取。建立和完善侦查程序来制约侦查权是必须且有益的。
The right of investigation is special so that it needs being restricted and supervised in modern society in which the concept of ＂rule of law＂ is popular.There are different kinds methods of restricting and supervising the right of investigation,including the procedure of investigation which restricts the investigation,the internal supervision from the investigation system and the external supervision from the prosecution and the public.Dealing with relation between procuratorate and police correctly and making investigation procedure run by law become the important measures to settle the problems in the process of investigation.The concept of ＂procuratorate-police integration＂ needs being discussed and ＂the prosecution leading police＂ is more appropriate when compared with it.Building and perfecting the investigation procedure is a must and profitable to restrict the right of investigation.
