摘要
最低工资标准是一项旨在"维护劳动者取得劳动报酬的合法权益,保障劳动者个人及其家庭成员的基本生活"的"保障制度",但在政策执行层面却不仅是保障制度,还被附加了更多政策目标,成为"工资增长制度"。本文利用珠三角农民工201 0年截面数据以及2 000~201 0年的面板数据研究发现,最低工资标准对农民工工资增长具有显著作用,但仍存在一定问题:其一,最低工资标准设置偏低;其二,小时最低工资"软约束";其三,最低工资标准执行情况并不理想。另外,我们认为最低工资制度在政策实践上被操作为工资增长制度,尽管发挥了一定作用,但也可能造成了一些不良后果:其一,给企业依照最低工资标准执行低工资提供了合法性借口;其二,造成农民工工资增长的路径依赖,进而可能会抑制集体谈判制度的形成。因此,我们应当反思最低工资标准的政策目标,还原其社会保障制度的本质,并尽快建立促进农民工工资稳定增长的长效机制。
The minimum wage standard(TMWS)is a 'security system' that aims at 'protecting the legal rights of the basic living standard for both laborers themselves and their families'.However,in the aspect of carrying out the policy,not only is TMWS a security system,but also more policy objectives are appended to it,making it 'a system of the wage increase'.Using the crossover data of 2010 on the work-peasants in Zhujiang Delta and the panel data between 2000 and 2010,we have discovered that TMWS has an obvious effect on the increase in the wage of peasant-workers.But this effect is limited:firstly,TMWS is low,secondly,the control of the minimum wage paid by the hour is not strict, and thirdly,the application of TMWS is not ideal.Besides,in our opinion,the minimum wage system has some effects when operated as a wage growth system,but it has some undesirable consequences:on one hand,it has provided a legal excuse for enterprises to pay low wages according to TMWS;on the other,it has led to a path to the dependence on the wage increase of peasant-workers,thus possibly restricting the formation of the system of the collective negotiations. Therefore,we should reconsider the policy objectives of TMWS,restore its essence as a social protection system, and construct,as soon as possible,a long-term mechanism for the promotion of the steady increase in the wages of peasant-workers.
