摘要
伴随着世界范围内体育运动的蓬勃发展,国际体育纠纷也在不断增加。以仲裁方式解决国际体育纠纷势必不同于传统商事仲裁的解纷机制。体育纠纷的可仲裁性、仲裁过程中实体性与程序性问题的法律适用、复议仲裁等问题构成了国际体育仲裁的独特之处。在与普通商事仲裁比较的基础上对国际体育仲裁的特殊性进行分析,将有助于大众更好地了解国际体育仲裁,更好地发挥体育仲裁在止纷定争方面的作用。
As the vigorous development of the sports in the whole world, the sport disputes tend to inrease. The settlement of sport dispute is dif- ferent from the traditional arbitration. The possi- bility of arbitration, the law application the materi- al problem and the procedural problem and the re- considering arbitration consist of the unique fea- ture of International sports arbitration. Analyzing of those issues will help people to know better a- bout international sports arbitration, and take ad- vantage of it for disputes settlement.
