摘要
关于持有的属性,即持有是不是一种行为,如果是一种行为,在行为形态上是作为还是不作为?对此,中外刑法学者有六种观点,即:行为否定说、作为说、不作为说、择一说、修正的择一说、第三种形态说。持有是一种行为,而不是行为之外的又一种犯罪存在形式。在现有的犯罪论体系与行为概念中,将持有解释为行为是必要的和可行的。在行为形态上,持有应归属于作为的范畴。
It is discussed concerning the attribute of possession,that is,whether it is a kind of conduct,and if it is,should it be defined as a kind of conduct？ There are six view points domestically and abroad about this issue such as theory of behavioral contravention,theory of action,theory of omission,theory of option between action and omission,revised theory of option between action and omission,and theory of third behavioral pattern.Possession is an action,but not another state of crime which exists beyond the range of conduct.It is necessary and possible to define possession as conduct in the present criminal theoretical system and behavioral concept.On the issue of behavioral pattern,possession should be classified into the range of action.
