摘要
基于对传统知识权界定现状、传统知识权法律关系、传统知识权的本质属性及其与其他权利的关系的综合研究;提出传统知识权作为社会权范畴中的一种具体权利,应当是指在生产生活实践中创造、发展、保存、传承传统知识的传统社群就该种传统知识所享有的精神权利和财产权利的总称。
Based on comprehensive study on the status quo of defining traditional knowledge fights, legal relations of traditional knowledge rights, the nature of the essence of traditional knowledge rights and their relationship with other rights, it is proposed that as an actual right in the domain of social rights, the traditional knowledge right should refer to the generic terms of the spiritual rights and prosperity rights of the traditional knowledge enjoyed by the traditional social communities who create, develop, preserve and inherit traditional knowledge in their life and production practices.
