摘要
就业平等权受到就业歧视案的现实质问,在理论的分析上存有权利定位的偏颇和制度促进的诸多软肋。于是,就业平等权的实现亟待理论的反思和重构。通过经济法实现命题的驳正这一理论上的反思,经济法的实现仍是就业平等权可行和应然的选择。以制度的限制和制度的促进这一"规制"的理论为基础,本文提出有必要修正过去理论研究中刚性制度的不足,以制度的促进保障就业平等权的实现。
The improper right orientation and weaknesses in institution motivation,in theoretical analysis,exist in the realistic questions bombarded to equal employment right by the cases of employment discrimination.Therefore,it's necesarry to reconsider and reconstruct the theory to realize equal employment right.Through the theoretical reflection on correcting the realization of Economic Law,the paper proves that the realization of Economic law is still the possible and obligatory to realize the equal employment right.Based on the "regulation" theory of the restriction of system and the motivation of institution,this paper proposes that it is necessary to correct the weaknesses of the rigid system in the past theoretical research,so that the realization of equal employment right can be guaranteed by promoting the system.
