摘要
作为犯罪的高级形态,有组织犯罪组织严密,危害严重,但发现不易,查处困难。有组织犯罪的组织化程度愈高,形式也日趋公司化、企业化,手段日趋现代化,犯罪的领域也愈趋扩大。因此,选择最优的治理手段势在必行。对有组织犯罪从"打早"、"打小"开始,力求将其遏制在萌芽之中,既可以避免或减少被害,同时有组织犯罪在新萌状态下犯罪组织化程度不高,可达成投入少、效果好的遏制效果。而要达成打早打小的效果,尚需相关法律规则的完善与观念的支撑。
As advanced form of crime, organized crime is well organized and does great harm to society. However, it is not easy to find out and deal with this crime. This kind of crime is becoming more and more organized and it tends to become corporated and enterprised. Meanwhile,its ways tends to be modernized and its crime area expands. So, the choice of best way of dealing with it is imperative, striking it as early as possible is the best way to control it when it is still in bud. In this way, harm can be avoided and costs can become lower accordingly. Surely, the perfection of relevant rules and support of ideas are needed to achieve such result.
