摘要
自由贸易区成为目前最受追捧的区域贸易安排形式。原产地规则是判定一项产品是否原产于某一成员国继而享有优惠待遇的基本法律依据,对自由贸易区的存在和运行有着至关重要的作用。以美国为核心的北美自由贸易区是当今世界上较为成功的区域贸易实践,而其原产地规则也被喻为世界上最成熟、最复杂的模式,并被其后建立的自由贸易区所效仿参照。本文将以北美自由贸易区的原产地规则为研究对象,对其具体内容、规则特点以及实施中对本区域产生的经济影响做深入探讨和分析。
The Free Trade Agreement has become the most popular form of regional trade arrangements. Rules of origin are fundamental criteria to judge whether a product is originated in a member country or area and thus enjoy contractual preferential treatment. Therefore, rules of origin is essential to the existence and implementation of a free trade area. The North American Free Trade Agreement (NAFTA for short) is one of the most successful regional economic cooperation whose rules of origin is regarded as a mature but complex sample which has been learned by many other countries as a reference. This paper discusses the specific origin criteria in NAFTA and its characteristics, and analyzes the impact of economy and trade on each member respectively.
