摘要
片面共犯是共同犯罪的特殊形式。在我国关于片面共犯理论上存在肯定说和否定说之争。片面共犯在一定程度上得到了刑法分则及司法解释的肯定。片面共犯符合犯罪的构成要件,在司法实践中应视案件的具体情况给予片面共犯以刑法处罚。
Unilateral accomplice is a special form of joint crime.In China,there is a dispute about unilateral accomplice between negative and positive views.To a certain extent,unilateral accomplice has been recognized by criminal law and judicial interpretation.Unilateral accomplice meets the essential elements of crime and should be given criminal penalties according to the specific circumstances of the cases in judicial practice.
