摘要
我国失业保险制度制定从最初的1986年《国营企业职工待业保险暂行规定》到趋于完善的《失业保险条例》,从1999年的《失业保险条例》到目前的发展,失业保险制度的制定过程风风雨雨,通过政策制定者"摸着石头过河",对政策的渐进修改,进而形成了现今比较完善的失业保险制度。但是随着社会的发展进步,失业就业的多样化发展,目前《失业保险条例》作为我国失业保险的主要法律依据,在执行过程中还存在着覆盖面较窄,职工界定不明晰,失业保险金给付期限长、待遇低,失业保险基金收支不平衡,再就业和预防失业功能未能得到重视等问题。通过分析这些问题,提出相应建议意见,以期我国失业保险制度能够更加完善。
The development process of China's unem- ployment insurance system from "State-owned enterpris- es Provisional Regulations on Unemployment Insurance for workers" in 1-86 to"Regulations on Unemployment In surance"which is more better in 1999, with the social development and the diversification of employment, the development of unemployment, the State Council promul- gated the "'Regulations on Unemployment Insurance."in 1999, as our principal legal basis for unemployment in- surance still have some questions in the current imple- mentation, such as the narrow coverage, workers do not define clearly, long pay period of the unemployed in- surance ,low pay level, unemployment insurance fund imbalances, re -employment and prevent unemployment function has not been more attention to other issues, Through analysis of these issues and put forward sug- gestions and some relevant views to wish our unemploy- ment insurance system can be further improved.
