摘要
气候难民是一种主要由气候异常变化所导致、客观上被迫迁移并带有跨越国界等特征的新型难民,当前对其国际立法保护存在概念不清、责任不明、割裂本质等主要困境,但通过论证各种困境,完全可以在立法上寻找到出路。
Climate refugees,a new type of refugee,are caused mostly by abnormal climate changing,and are objectively forced to migrate and cross national boundaries.The dilemma in current international legislation to protect them appears as the difficulties like the concept unclear,the responsibility ambiguous,the nature fragmented,etc.Still,correspondent solution can surely be sought out in legislation by demonstrating and verifying various kinds of difficulties.
