摘要
教师惩戒权是国家相关法律赋予教师管理学生的职权权利,也是教师履行教育教学职责而必须具有的基本权利。目前我国教师惩戒权的行使存在着惩戒行为背离了惩戒的目的、惩戒"过度"或"无度"、以惩代教等问题和误区。针对这些问题,本文从法律制定、教师职业素质和教育行政管理三方面对教师惩戒权的行使提出了相应对策。
The punishment power is not a necessary authority which is given by relevant laws of the state to manage students,but also one of the professional rights that teachers should deserve.At present,the exercise of the punishment powerdeviated from thepurpose,such problems and mistakes likeexcessive punishments and unrestrained punishments or punishment instead of education exsit widely.This paper proposes the corresponding countermeasures from law-making and professional quality of teachers as well as educational administration aginst those problems.
