摘要
恶意透支型信用卡诈骗罪是信用卡诈骗中一种比较特殊的犯罪类型,目前已经出现各种表现形式,深入分析恶意透支信用卡犯罪,并且上升到理论层面,对司法实践具有一定的指导意义。为保护金融行业的健康发展,我们结合最新司法解释,着重分析了恶意透支型信用卡诈骗犯罪的犯罪构成,在对恶意透支行为进行详细剖析的同时,对实践中存在的问题提出了相关对策,以期对司法实践有所裨益。
