摘要
体育的法治化是实现体育强国目标的必然支持和保障,作为法治化另一进路的软法建设,在满足体育国际化交流合作的法治需求;促进政府体育管理职能转变;推动体育领域的民主法治建设;节约依法治体的成本方面发挥着重要的法治作用。建议进一步优化体育领域的软法建设,促使软法与硬法形成法治合力,推动体育的法治化进程,为体育强国目标的实现创造良好的法治环境。
The legalization of sports provides support and guarantee for achieveing the goal of a sports power. In the legal process, the construction of soft law plays an important role in such legal aspects as satisfying the law request of international exchanges and cooperation, promoting the transformation of governmental functions in sports management system, driving the democratic nomocracy construc- tion in sports field, and saving cost of ＂rule by law＂. The authors make suggestions for further optimi- zing the consruction of soft law, promoting the combination＇of soft law and hard law and accelerating the legal process in sports field. The construcion of soft law will provide sound legal environment for achieving the goal of sports power.
