摘要
社会保险权作为免除被保险人及其他受益人社会风险后顾之忧的权利,具有社会权的典型特性,也具有区别于社会救济权、社会福利权等社会保障权项的独特个性。同时,个人社会保险权的实际享有有赖于劳动权的实现,是劳动权的当然延伸。
The right to social insurance, which can relieve the insured and other beneficiaries＇ worries from various social risks, has typical characteristics of social right as well as distinct character compared with other social security rights, such as the right to social assistance, the right to social welfare, and etc. In the meanwhile, the real enjoyment of the right to social insurance is dependent on the realization of labor right, which implies that the right to social insurance is the definite extension of labor right.
