摘要
解决学校体育伤害事故纠纷,从形式上表现为对体育伤害事故的责任认定,实质核心问题是对伤害事故的合理赔偿。采用文献资料、逻辑分析、对比研究的方法,通过对发达国家学校体育伤害事故赔偿制度进行比较以及对我国现行学校体育伤害事故赔偿相关制度进行分析,提出根据我国国情,同时借鉴国外的先进经验,建立以侵权责任法为基础,保险和社会保障制度手段相结合的全面、高效的学校体育伤害赔偿的制度,以充分保障学校、家长、学生以及各方的合法权益。目前,实现这一制度还需要加强相关法治建设、完善保险制度和建立高效的救济途径。
Solve the school sports injury dispute,from the form of the sports injury accidents responsibility confirmation,essence is the core issue of reasonable compensation for injury accidents.This article use literature,logic analysis and comparative research method.Though compared the development country school sports injury accident compensation system and analysis the current school sports injury accident compensation system in our country.Put forward according to the conditions of our country,at the same time,learn from advanced foreign experience,to establish the tort liability law foundation,Insurance and social security system by means of combining a comprehensive and effective school sports injury compensation system.In order to fully protect the school,parents,students and the parties＇ legitimate rights and interests.At present,this system also need to strengthen the law construction,perfect insurance system and the establishment of effective relief way.
