摘要
既决事实是法院确定的终局判决所确认的事实。既决事实 ,对于将来的相关案件具有预决效力 ,这种效力源于判决的效力。适用既决事实属于法院的职责 ,法院应主动查明适用 ;当事人或控辩双方也可以申请法院适用。在我国诉讼实践中 ,适用既决事实存在障碍 。
Judged fact is such a fact that the determinate final judicial judgement has confirmed.Judged fact has predeterminative force which derives from effects of judicial judgement to relevant cases in future.It is the courts duty to ascertain and apply judged facts.Litigants may also ask the court for application of them.In the practice of lawsuit in the mainland of China,there are obstacles in applying judged fact.This article lists the main abstacles and gives way out of them.
